Terms and Conditions of Service

Endurance Nodes offers a strict 48-hour money-back guarantee, applicable solely to new clients on their first purchase. Refunds will only be issued in the event of a demonstrable and prolonged fault in our physical or network infrastructure (expressly defined as a total, continuous service interruption exceeding 24 consecutive hours). We do not issue refunds for server "lag" caused by poor user-side optimization, heavy modpacks, incorrect plugin configurations, in-game bans, or inability to use the control panel. After 48 hours, all sales are final.

While our infrastructure utilizes NVMe drives in a RAID 1 configuration to mitigate hardware failures, Endurance Nodes operates as an "Unmanaged" service. The client is the sole owner and strictly responsible for the integrity of their data. Endurance Nodes is not liable for the loss, corruption, or accidental deletion of worlds, databases, or configurations. It is the client's absolute obligation to generate and download external backups regularly.

Our servers are strictly designed for gaming and related services. It is strictly prohibited to use our infrastructure for cryptocurrency mining, Denial of Service (DDoS) attacks, botnets, hosting illegal material, malware, or malicious scripts. Additionally, server storage must be used exclusively for active game server files. Using the NVMe storage as a personal backup drive, media hosting (cloud storage), or attempting to bypass Control Panel restrictions will result in immediate service termination without a refund.

Billing cycles are generated automatically. If an invoice remains unpaid by its due date, the service will be suspended immediately. After seven (7) calendar days of suspension without payment, the server and all associated files will be irreversibly and permanently deleted from our systems.

To guarantee high availability and maximum performance for all clients on the same node, shared resources must be used reasonably. While clients may utilize their allocated vCores heavily during activity spikes, intentionally maintaining maximum CPU usage 24/7 or generating extreme, constant read/write disk operations (Disk I/O abuse) that actively degrade the physical NVMe hardware is prohibited. In such cases, we reserve the right to limit the server's performance, suspend it, or require an upgrade.

Endurance Nodes' technical support is strictly limited to ensuring that the physical infrastructure, network connectivity, and Control Panel are functioning correctly. We do not provide support for internal game configuration, third-party plugin installation, crash report analysis, or player management. For custom development and setups, we recommend our external services at EndStudios.

We strive to maintain a 99.9% uptime. Interruptions caused by scheduled maintenance (notified in advance) are not considered valid downtime. In the event of an SLA breach due to our hardware or network failure, the client's sole and exclusive remedy will be the extension of their active service duration, as strictly detailed and governed by our official Service Level Agreement (SLA) document. Under no circumstances will SLA breaches result in direct cash refunds to credit cards, PayPal, or any other payment gateways. In the exceptional event of an unprecedented DDoS attack that bypasses mitigation, Endurance Nodes reserves the right to temporarily null-route the targeted IP address to preserve the node's stability.

Endurance Nodes reserves the right to modify plan prices and allocated resources at any time. Active clients will be notified of any price changes at least thirty (30) days prior to their next billing cycle. Continued use of the service following the modification constitutes acceptance of the new pricing.

Endurance Nodes shall not be held liable for failure to perform its obligations, service interruptions, or data loss caused by events beyond our reasonable control. This includes, but is not limited to: natural disasters, datacenter fires, strikes, wars, catastrophic failures of international network providers (ISPs), or government actions.

Any attempt at fraud, chargebacks, or opening disputes through payment processors (such as PayPal or banks) will result in the automatic and immediate suspension of all services associated with the account, as well as a permanent ban from our platform. If you have a billing issue, you must contact our support team first.

Under no circumstances shall Endurance Nodes be liable for any loss of profit, loss of revenue, or indirect damages suffered by the client due to service interruption. In the event that any liability is determined on our part, the absolute maximum compensation shall never exceed the total amount paid by the client during the billing month in which the incident occurred.

The client must be of legal age in their jurisdiction or have the explicit permission and supervision of a legal parent or guardian to purchase our services. Endurance Nodes reserves the right to request official identification documentation if we suspect an account belongs to an unsupervised minor. Failure to provide verifiable parental consent or identification will result in immediate account suspension to comply with data protection laws. Furthermore, accounts are personal and non-transferable. The resale or transfer of the account to third parties without prior written authorization is prohibited.

Endurance Nodes reserves the right to refuse, cancel, or suspend services to anyone for objective reasons, including but not limited to: operational limitations, explicit violations of these terms, suspected payment fraud, or abusive behavior toward our staff. In the event of cancellation by our administration without the client having violated these terms, a prorated refund will be issued.

To provide our services, we collect basic information (such as IP addresses, emails, and billing history). Endurance Nodes will never sell or rent your personal information to third parties for commercial or marketing purposes. Data is only shared with strictly necessary third-party service providers (such as payment processors and automated mailing systems) solely for the purpose of delivering our services, processing transactions, and fraud prevention. All passwords and payment gateways are fully encrypted and out of our visual reach.

These Terms and Conditions shall be governed by and construed in accordance with the laws of Ecuador. Any dispute, controversy, or claim arising out of or relating to these services shall be subject to the exclusive jurisdiction of the courts of Ecuador.

The client retains all rights to the data, worlds, and configurations they upload. However, all content on our website, the 'Endurance Nodes' brand name, logos, design code, and graphic materials are our exclusive property and may not be copied, reproduced, or used without our prior written consent.

Creating multiple accounts to abuse first-time promotional codes, discounts, or affiliate systems is strictly prohibited. Any accounts found engaging in this behavior will be permanently suspended along with all active services without refund.

Clients must strictly adhere to the End User License Agreements (EULA) of the games they are hosting (e.g., Mojang/Microsoft's Minecraft EULA). Endurance Nodes is not responsible, nor will we issue refunds, if a client's server is blocked, blacklisted, or taken down by the game publisher for violating their respective terms (such as aggressive Pay-to-Win mechanics).

We are not liable for exploits, data breaches, data loss, or downtime caused by vulnerabilities, bugs, or malicious code within third-party software installed or utilized by the client, including but not limited to Minecraft server engines, Java environments, or the Control Panel software itself.

Endurance Nodes reserves the right to update or modify these Terms and Conditions. Clients will be notified via email of any material changes at least fifteen (15) days prior to their implementation. Continued use of or access to our services following the effective date of the changes constitutes absolute acceptance of the updated terms.

The client agrees to indemnify, defend, and hold harmless Endurance Nodes, its owners, employees, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorney's fees) arising from the client's use of and access to the service, their violation of any term of these Terms and Conditions, or their violation of any third-party right, including without limitation any copyright, property, or privacy right.

If any provision or part of a provision of these Terms and Conditions is determined to be unlawful, void, or unenforceable by a court of competent jurisdiction in Ecuador or any other applicable jurisdiction, that provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms. Such determination shall not affect the validity and enforceability of any other remaining provisions.

The failure of Endurance Nodes to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by the administration of Endurance Nodes.

All prices listed on our website are exclusive of any applicable taxes, levies, or duties imposed by taxing authorities. The client is strictly responsible for the payment of all such local or international taxes associated with their purchases. Endurance Nodes will not absorb bank fees or international transaction taxes.

Before filing any formal legal claim, the client agrees to first attempt to resolve the dispute informally by contacting our official support team. If the dispute is not resolved within thirty (30) days, any commercial (B2B) disputes shall be resolved exclusively in the corresponding legal instances of Guayaquil, Ecuador. We acknowledge that mandatory international consumer protection laws may grant end-consumers (B2C) the right to file claims in their country of residence; however, all claims, regardless of jurisdiction, will strictly require prior mandatory informal mediation.

These Terms and Conditions constitute the entire and exclusive agreement between the client and Endurance Nodes regarding our services. This document supersedes and invalidates any prior agreements, communications, or proposals, whether oral or written (including, but not limited to, informal promises made via Discord, email, or social media).

Endurance Nodes respects the intellectual property rights of others. If we receive a valid claim of copyright infringement (such as a DMCA Takedown Notice) regarding content hosted on a client's server, we reserve the right to immediately suspend or terminate the offending service without prior notice or refund. The client bears full legal responsibility for any copyrighted material they upload or distribute.

By using our services, the client represents and warrants that they are not located in, under the control of, or a national or resident of any country subject to comprehensive United States or international economic sanctions (including, but not limited to, Cuba, Iran, North Korea, Syria, and the Crimea region). Endurance Nodes reserves the right to terminate accounts immediately if a violation of international trade laws is detected.

While our services are optimized for gaming, the uploading, hosting, or distribution of explicit adult content, pornography, or any form of Child Sexual Abuse Material (CSAM) is strictly and absolutely prohibited. Any detection or report of such material will result in the immediate and permanent destruction of the server, a lifetime ban from Endurance Nodes, and an automatic report to the relevant law enforcement agencies.

As stated in our suspension policy, services unpaid after seven (7) days are terminated. The client expressly acknowledges that "termination" means the automated, irreversible, and cryptographic wiping of all associated NVMe storage sectors. Endurance Nodes does not hold, archive, or retain any client data, backups, or configurations past the exact moment of termination. We entertain no requests for data recovery post-termination, as the data ceases to exist.

The client is entirely responsible for maintaining the confidentiality and security of their account credentials, passwords, and billing information. Endurance Nodes is not liable for any data loss, server hijacking, or unauthorized purchases resulting from compromised client passwords, shared account access, or failure to enable Two-Factor Authentication (2FA). Any actions taken through the client's account are legally deemed to have been authorized by the account holder.

As hardware and technology evolve, Endurance Nodes reserves the right to retire, deprecate, or discontinue specific hosting plans, nodes, or entire services (End of Life). In the event that a service is being permanently discontinued, active clients will receive a minimum of thirty (30) days' written notice to back up their data or migrate to a new plan. After this period, the service will be permanently shut down, and Endurance Nodes holds no liability for any data left behind.

Endurance Nodes reserves the right to assign, transfer, or subcontract its rights and obligations under these Terms and Conditions to a third-party entity (for example, in the event of a sale, merger, or acquisition of the company) without prior notice or explicit consent from the client. As previously stated, the client may not assign or transfer their account to third parties.

By using our services, the client agrees that all agreements, notices, disclosures, and other communications that we provide electronically (whether via email, Control Panel notices, or on our website) satisfy any legal requirement that such communications be in writing. It is the client's responsibility to maintain a valid and up-to-date email address in our system.
